TERMS & CONDITIONS By placing an order with Barker Memorials & Monuments LLC (BMM), you are agreeing to the following terms & conditions: Sketches: Customers will be provided a sketch of their granite memorial order at no charge unless it’s a sketch-only order. Once the sketch is approved, production is started. Any changes after the sketch is approved will incur additional charges and may not be possible depending on the stage of production. Guarantee: We use only the highest quality monument grade granite for your memorial. Our goal is 100% customer satisfaction. We want you to have peace of mind that your memorial will last many lifetimes. For specific details, please consult the warranty and guarantee provided by our manufacturer, Premier Memorial. Our Sales Consultants will be able to provide you with a copy. Materials: Granite is a natural material and has variations. Color, tone, and grain variations are to be expected. Exact color matches are not guaranteed. Returns are not allowed for natural granite variations. Errors: If an error is made and BMM is responsible, the problem will be corrected or a new memorial will be produced free of charge. Errors made by the customer will be charged at 80% of the original selling price to replace; if the original memorial is returned to BMM freight prepaid. Ownership: Ownership of this memorial is retained by BMM until all monies due BMM are paid. This may include the right for BMM to remove a memorial from a gravesite until all funds are paid in full. If a memorial is removed for non-payment, a reinstallation equal to the original installation fee will be collected before re-installing the memorial. Terms: All orders require at least a 50% deposit to start production. The balance is due prior to pickup, delivery, and/or installation (if provided). Deposits on special order & non-stock items are non-refundable. Past due accounts will be charged a 1.5% interest per month (18% annually). Payments: All payments are in US funds. Cash, checks, and credit cards are accepted. A non-sufficient funds (NSF) fee of $35.00 is charged on all checks returned to BMM. Ordering: Any order not manufactured within 6 months after the order date due to delay in sketch approval may be cancelled. Orders must be re-submitted and updated pricing will be used. Sketches that are open and have not had an order placed within 90 days will be billed at the current sketch rate. Prices include lettering and design per the appropriate design groups. Additional charges may apply to design work that is outside the standard design group. Our price list includes all the standard items we represent, not all items may be in stock at the time of the order. Please call for availability and lead times. All orders must be signed on the front of this agreement before production can begin. No future lettering, including final dates, is included. Cancellations: Orders can be cancelled and deposits fully refunded if cancellation is received in writing within 7 days after the order is placed. If cancelled after the grace period, restocking fees of $75 or 20% of the granite charges (whichever is more) plus the cost of sketch will be charged for standard inventory orders. Quotations: All quotes provided are valid for 30 days. Prices are subject to change without notice. Lead Times: Upon placing this order, we will inform you of the approximate lead time for manufacture and delivery of your order. Delay caused by strike, fire, natural disaster, or other situations beyond our control may delay your order. Field inscription season is typically April through October and is weather dependent. We will inform you of any delays beyond the original lead time quoted when placing your order.
